Woman sues Match.com for $10M after attack

22 hrs.

A Las Vegas woman who was severely beaten by a man she met through Match.com is suing the online dating site for $10 million?two years and multiple surgeries after the attack that left her hospitalized for months.

The woman, Mary Kay Beckman, was stabbed multiple times with a butcher knife on Jan. 21, 2011?by?Wade Mitchell Ridley, and when?the knife broke, he stomped on her head. Ridley, who was sentenced to?28 to 70 years,?died in prison last year. He was also facing a murder charge in Arizona for the stabbing death of a former girlfriend a few weeks after the attack on Beckman.

Beckman filed suit in Clark County, Nevada,?accusing Match.com of negligence, negligent misrepresentation, deceptive trade, failure to warn and negligent infliction of emotional distress.

The site, she said, failed to warn her about the dangers of meeting "an individual whose intentions are not to find a mate, but to find victims to kill or rape."

The real estate agent said she joined Match.com about a month before her first in-person meeting with Ridley on Sept. 26, 2010. They dated for 10 days, but she called it off. That's when Ridley started sending her threatening and harassing messages.?

On Jan. 21, 2011, Ridley attacked Beckman in her garage, and left her for dead, she says, when she stopped making a "gurgling noise."?

Beckman, now 50, continues to recover and to speak out against online dating?"I do not believe that online dating is a safe venue for men or women,"?she?recently?told?a?local?FOX?TV?reporter.

Match.com, in a statement to NBC News Friday, said that what happened to Beckman "is horrible, but this lawsuit is absurd.?The many millions of people who have found love on Match.com and other online dating sites know how fulfilling it is. And while that doesn't make what happened in this case any less awful, this is about a sick, twisted individual with no prior criminal record, not an entire community of men and women looking to meet each other."

Safety, the site said, "is very important to Match," which, like many other online dating sites, includes online and offline tips for staying safe.

In California, Match.com and two other dating sites, eHarmony and Spark Networks, signed a joint statement of business principles, agreeing to screen for sex offenders and take other safety steps after a woman was assaulted on a date, the state attorney general's office said last March.?

The joint statement ?was prompted by the 2010 sexual assault of a Los Angeles-area woman by a man she met through Match.com, a spokeswoman for the state attorney general's office said. The woman sued Match.com, seeking a court order requiring the site to check applicants' backgrounds to weed out convicted sex offenders. She dropped the suit after the site provided proof of such screening.

Meanwhile, in the last two years, friends and work associates of Beckman have held fundraisers for her, including one last year, with information shared about it on YouTube (see video below).

Even novice PC users have created flourishing businesses, and you could be next. The following article will give you the information you need to become a successful Internet marketer.

Every email you send out should ask your customers to take a specific action right away. The action may be to visit a particular place online or to make a certain purchase. This also gives you valuable insight on your email campaign?s effectiveness since you can track each of these actions.

TIP! Use tech tools to help measure how many visitors become customers to help improve your marketing strategy. The most successful sites use customizable applications that track site statistics like sales and traffic.

Use social media sites such as Twitter and Facebook as a part of your Online marketing campaign. You can communicate quickly on social media websites, giving your customers messages about sales and promotions. However, it is important that your comments or tweets are not overly promotional in nature. Try to keep your posts valuable and insightful, and only include marketing in a portion of them.

Allow customers to post reviews on your site. User reviews can help boost sales as well as increase your online presence.

The appearance and performance of your website is just as important as the in-store buying experience. Make sure you always test your links and ads to ensure that they work for your visitors. Costumers will leave if your site is not working properly.

TIP! It is a good idea to keep contact information for your customers. Give your clients the opportunity to opt-in to signing up with a subscribe link or making their email address part of the ordering process.

Make a game if you want to attract others to your website. Customers love to play free games online, and that can keep people coming back for more after they play once. Use the game for subtle product advertising. If you are a purveyor of pet supplies, for example, you might design a canine companion game that incorporates specific products and services you offer.

You should guarantee your products and say so in each of your advertisements. Customers want to know that your product is a sure bet before they part with their hard-earned cash. The only limit to what you can guarantee is what you decide it to be. Two options are 90 day guarantees and lifetime guarantees. Tailor your guarantee to your product.

Ask for opinions from people who don?t choose to buy from you by adding a simple feedback form after your sales pitch. If they decided not to purchase because of a problem with your website, you can improve it.

TIP! Contemplate the various methods you are interested in using in your web design efforts. For example, you may find that some of the best ways to go about marketing your site won?t cost you a single penny.

It is important to know what audience you want to reach and what sort of content will make them want to visit your site. Knowing who you want to reach makes it easier to produce content that will bring visitors back to your site again and again.

When it comes to Web marketing, be sure customers are aware that your site?s checkout process is secure. Many online users are reluctant to provide personal or financial details over the Internet, so it is important to assuage them with guarantees that this information is truly safe.

You could give a part of your profit to a charity if you believe your audience will be interested in helping out a good cause. This should be clearly advertised, though not too excessively, on your website. You do not give a large percentage of your profits to a charity for this to be a good marketing strategy.

TIP! Sell your products by motivating your customers in a positive way. Let customers know which of their problems your product will solve, and how it will solve them.

It is always best to handle customer complaints personally. Outsourcing your customer service might seem to be a good solution, but the resolutions offered by these companies can often seem impersonal and may infuriate an already angry customer even more. If an unhappy customer sends you an irate email, respond yourself to that email, offer a resolution, and let the customer know that you value him or her and his or her business.

Don?t be afraid to get started. You can learn from your experience as you go along. Use this advice to reach your ultimate goal.

OWINGS MILLS, Md. (AP) ? Jim Caldwell enjoys his job as offensive coordinator of the Baltimore Ravens, and he's quite good at it.

Yet he has no intention of making that the final line of his resume. That's because he longs to be a head coach again, even though his focus right now is getting the Ravens prepared to face San Francisco in the Super Bowl next Sunday.

While at the Senior Bowl last week, Ravens general manager Ozzie Newsome says several NFL general managers told him they would have interviewed Caldwell for a vacancy if Baltimore wasn't in the midst of a playoff run.

Caldwell ? the former head coach of the Indianapolis Colts ? wants to try to again somewhere.

He said Friday, "I'd like to do it one more time."

P&G Tips to maximize family budgets

The holiday season is now over and as we sit back and reflect about the joyous festivities, we can't help but also think about our 2013 budget which may or may not have a dent in it after gift giving and holiday hosting. Soon we will be facing the much?dreaded?post-holiday bills and some of us may be scratching our heads as to what happened and how we can get back on track for the New Year.? Sandra Hanna, CEO and co-founder of www.smartcookies.com has some great tips to help ease the pain of the headache that comes with post-holiday budget blues. We had the opportunity to listen to Sandra speak at the P&G event last November, shes a fantastic person with some amazing ideas to help families everywhere.?

Find free outdoor activities:

During the weeks the kids are off on holidays, or on weekends, why not participate in free outdoor activities like sliding at a local public hill, skating at a local public rink or even look into free winter festivals that may be taking place in your neighbourhood. These activities keep everyone happy and won't make an impact on your already dented budget.?

If you live in a close-knit neighbourhood you can also invite the local kids together for a snowman parade. This is where kids build snowmen and parade them around the block in a wagon or sled. Maybe even have a judging contest (of course everyone would win, it's all for fun after all).

Workout at home:

There's no need to keep up with the?Jones'?and spend on a gym membership this year. You can get a simple workout right at home. If you're willing to tough it outside a brisk walk, run or snowshoe could be the best workout you have all year. Best of all these activities cost you nothing but time and energy, if you want to work off that post-holiday overindulgence, these are great starting points. In winter months it can even be fun to get a group of friends together and share winter workout gear or workout music playlists to help eachother get motivated to meet their workout goals. With the money saved, you could all enjoy a nice hot chocolate or late for a treat afterward.?

Cold water wash:

No matter what the season, I wash our laundry in cold water. It saves money on electricity, use of hot water and also not as hard on the clothing. Less chance of shrinking that new sweater mom got me for Christmas. Using cold water and detergent like Cold Water Tide can actually save about $7 a load in energy costs. With the amount of laundry we do per week - those savings can definitely add up!

Winter Staycation:

Want to take the family on a vacation on an already tight budget? Why spend hundreds on a vacation somewhere hot and balmy when you can save money on a staycation right in your own city! You'd be surprised how fun and inexpensive a staycation close to home can be. Local hotels, restaurants and attractions often have off-season discounts you can cash in on. Just do a little research about where you're heading and call in advance letting them know about your local staycation to see if they have any discounts and savings you could use for your family. Being local you may just find a cheap hotel room rate or family meal discounts in hotels and restaurants!?

For more great money saving tips don't forget to follow @SmartCookies on Twitter and Like the SmartCookies Facebook fan page!

Happy winter budgeting!

Ohio judge weighs whether to keep rape trial open

STEUBENVILLE, Ohio (AP) ? A battle over closing the trial of two Ohio high school football players charged with raping a 16-year-old girl appeared to end Friday as an attorney withdrew his motion, saying that moving the trial would suffice to protect his client.

Defense attorney Walter Madison previously raised concerns that an open trial could lead to potential witnesses on his client's behalf being intimidated following intense publicity and social media commentary about the case. Madison said after the hearing that he believes the related motion to move the trial out of Jefferson County to reduce the possibility of witness intimidation or harassment would address his concerns.

"My concern, and that being that witnesses are comfortable and willing to participate in this process," he said.

An attorney for the girl said he'd be willing to file a similar motion for closing the trial, and the Ohio Attorney General's Office reiterated its support for the closure. But no formal motion was presented.

In arguing to move the trial, Madison said two potential witnesses on behalf of his client, Ma'Lik Richmond, had recently received threats.

Despite Madison's last-minute change, attorneys for media outlets including The Associated Press presented arguments supporting an open trial to ensure public confidence in the proceedings.

Judge Thomas Lipps said he'd consider their statements. Lipps, who previously rejected a request to try the two players separately, plans to rule next week on motions to move the trial and delay it.

The state opposes all of those motions.

Madison also wants Lipps to order that the girl be referred to as the accuser, not the victim, because he said "victim" implies that something happened to her that's been proven.

Lipps, a special judge brought in from Hamilton County to oversee the trial, opened with a philosophical statement of the issues at stake.

"This case is about our children, what they do when they're not under their parents' watchful eye as they venture out into their teenage years, how they act when they're with their friends, and how they deal with parties and drinking," Lipps said.

"How they react to the pressures of their friends, their relationships, their perceptions of themselves and others, their possible engagement in sexual activities and how emails and texting and social ... media these days affects the way our children communicate and how their words or actions are captured or recorded."

The athletes are accused of attacking the girl twice after an alcohol-fueled party in mid-August in Steubenville in far eastern Ohio. Three other students who witnessed the attack but weren't charged are expected to testify at next month's trial. The girl attends a high school across the river in West Virginia.

Two of the witnesses captured video and photo images of the attacks but deleted them shortly afterward.

The girl and her parents want the trial closed to maintain the girl's anonymity and keep evidence that a judge might rule inadmissible from becoming public, their attorney argued in a court filing Tuesday. That could include "harmful" and "legally non-relevant" evidence, attorney Robert Fitzsimmons has said.

The AP generally doesn't identify people who say they are the victims of sexual assault.

An attorney for the second defendant, Trent Mays, argued the case should be moved to a county with a bigger courthouse where crowds of protesters trying to intimidate witnesses favorable to the accused could be better controlled.

"My big concern is that witnesses aren't going to come in walking past hundreds of people wearing masks," said Columbus defense attorney Adam Nemann.

Brian Deckert, a special prosecutor from the Ohio Attorney General's office, said witnesses could be compelled to testify by subpoena and would have to testify truthfully because of perjury laws.

Attorney General Mike DeWine, whose office is prosecuting the case, says it will be difficult enough for the girl to testify, let alone in a public hearing open to the media.

News organizations arguing to keep the hearing open say the case is already subject to speculation that it won't be fully investigated and prosecuted because it involves the city's popular football team. Keeping it open eliminates that speculation, according to arguments by the AP, ABC, CNN, CBS News, The New York Times and WEWS-TV.

Pentagon lifts U.S. ban on women in combat

WASHINGTON (Reuters) - The Pentagon lifted its ban on women in front-line combat roles on Thursday in a historic step toward gender equality in U.S. armed forces after 11 years of nonstop war.

The decision came with important caveats, and sweeping change will not happen overnight for women, nearly 300,000 of whom have deployed to Iraq and Afghanistan since 2001.

But the move by Defense Secretary Leon Panetta, with the support of President Barack Obama, could open 237,000 positions to women in America's armed forces and an expand opportunities for career advancement.

"The department's goal in rescinding the rule is to ensure that the mission is met with the best-qualified and most capable people, regardless of gender," Panetta said in a statement.

A senior defense official said Panetta's goal "is to open everything" to women. Service chiefs will have to ask for exceptions to keep some positions closed.

Panetta, who is to address a Pentagon news conference on Thursday, made the decision after the Joint Chiefs of Staff concluded it was time to integrate women "to the maximum extent possible," according to a statement.

Gender-neutral performance standards will be developed for all the new jobs opening to women, officials said. But whether that means the physical requirements become more or less rigorous remains to be seen, they added, cautioning that they would depend on the actual demands of the position.

An example of a physically demanding job that may be out of reach of women without significant upper body strength could be in front-line tanks, where soldiers need to lift and load heavy ammunition in confined spaces using mainly their arms.

A U.S. official, speaking on condition of anonymity, said the changes would be gradual. The service chiefs have until May 15 to offer plans to implement the new policy by January 1, 2016.

"The secretary understands with a change of this magnitude it does take some time," the official said.

The move topples another societal barrier in the U.S. armed forces, after the Pentagon in 2011 scrapped its "Don't Ask, Don't Tell" ban on gays and lesbians serving openly in the military.

The American Civil Liberties Union, which filed a suit in November seeking to force the Pentagon to end the ban on women in combat, applauded the decision, which rescinds a 1994 policy preventing women from serving in small front-line combat units.

For many women service members, the move is belated acknowledgement of the realities of the past decade of war, in which there were often no clearly defined front lines. Eighty-four women have been killed in hostile action in Iraq and Afghanistan and nearly 1,000 wounded.

Women serve in combat roles for the armed forces of a few developed nations, including Canada and Israel, but officials say demand from women for such jobs in NATO nations is very low. In 2010, Britain decided after a review that it would not change rules excluding women from infantry or combat teams.

"I feel like it's beyond time," said Staff Sergeant Tiffany Evans, a soldier stationed at Fort Hood, Texas.

The United States is drawing down its some 66,000 remaining forces from Afghanistan through the end of 2014, when only a small residual force is expected to remain. It is possible that some women may see themselves in new combat roles before that withdrawal is complete.

"I don't think we can exclude that possibility," one senior defense official said, speaking on condition of anonymity.

Logitech Q3 earnings reveal plans to sell off Harmony remote, video security divisions

Logitech Q3 earnings reveal plans to sell off Harmony remote, video security divisions

The fiscal 2013 Q3 numbers from Logitech are in, and according to new CEO Bracken P Darrell, the "disappointing" results will require immediate action to turn around -- action that includes selling off its remote control (read: Harmony) and digital video security divisions. Logitech notched an operating loss of $180 million, on sales of $615 million. At this time last year, we were still looking forward to a refresh of the line which resulted in the Harmony Touch, but that does not appear to have turned things around. Harmony remote sales fell off by 55 percent based on units, although a focus on higher end devices like the new Touch meant revenue declined only 24 percent.

According to a slide in the presentation, after a strategic review, Logitech is focusing on tablet accessories, wireless speakers as well as keeping its lead in PC-related products. Other "non-strategic" products are also on the chopping block, and we'd have to think that includes video conferencing after yesterday's announcement. Current owners worried about potential support should be taken care of however, as a post by Darrell on the support forums indicates company will continue to provide support during the sale process and all current warranties are still in effect. There's no word about a possible buyer, but we'll be tuning into the earnings call tomorrow morning to see what additional information is revealed.

Outdoor Industry Association Recognizes Rafferty Jackson & Travis ...

Awards Presented January 22 at OIA?s Thought Leader Dinner.

Outdoor Industry Association

Boulder, Colo. --(Ammoland.com)- Outdoor Industry Association (OIA) presented its annual OIA Advocacy Leadership Awards to Rafferty Jackson of VF Outdoor, Inc., and Travis Campbell of Far Bank Enterprises, during the OIA Thought Leader Dinner yesterday, on the eve of Outdoor Retailer Winter Market in Salt Lake City, Utah.

Now in its third year, the OIA Advocacy Leadership Awards recognize individual OIA members who have significantly contributed to the advancement of the OIA policy agenda and the outdoor industry?s stature in the public policy arena.

?Travis and Rafferty are both tireless advocates for the outdoor industry,? said Frank Hugelmeyer, president and CEO of OIA. ?Their leadership has helped amplify our voice in Washington, D.C., and inspired others to get involved in policy efforts that are critical to the long-term health of our industry.?

Jackson is vice president and general counsel for VF Outdoor, Inc., one of the largest outdoor industry companies, with global supply chains. She understands the importance of favorable trade policies for both importers and domestic manufacturers. As chair of the OIA Trade Advisory Council, she leads industry efforts to create a stable and predictable trade environment for outdoor industry businesses, lower costs for outdoor businesses and their customers, and reflect the industry values of social and environmental responsibility.

Jackson has cultivated strong relationships with policymakers in Washington, D.C., through her frequent visits to Capitol Hill and regular communications with Congressional leaders. She consistently participates in OIA?s Capitol Summit and contributes to OIAPAC, the outdoor industry?s political action committee?two initiatives that are a critical part of OIA?s strategic policy efforts.

?The Outdoor Industry Association is a collection of world class brands, innovators, business visionaries and passionate people dedicated to responsible global engagement,? said Rafferty. ?It is easy to advocate for our industry?s trade agenda when it is committed not only to delivering the best products to our consumers to enable them to get outdoors, but also to creating American and global jobs.?

Campbell serves on the OIA board of directors and is a proven industry leader. As president and CEO of Far Bank Enterprises, he represents three of the leading fly fishing brands?Sage, Redington and RIO?and recognizes the need to promote participation and protect access to public lands. He is well versed in advocacy, having served on the board of the American Fly Fishing Trade Association for seven years, chairing their trade development committee and acting as secretary for the executive committee.

Campbell frequently meets with Congressional leaders and members of the administration to promote favorable trade policies. He is also vocal in his support for recreation policies, signing letters to promote funding of the Land and Water Conservation Fund (LWCF), Recreational Trails Program and other important initiatives. In addition, he penned an op-ed in favor of the LWCF, and participated in a video to highlight the importance of protecting Bristol Bay. Campbell has also been very involved in promoting President Obama?s America?s Great Outdoors initiative.

?I don?t consider the advocacy work I do as fundamentally different than many of my other corporate responsibilities,? said Campbell. ?We are a natural resource dependent business, so making sure our employees and customers have access to quality outdoor experiences, healthy fisheries, and innovative products that can be purchased at a fair price are all part of ensuring our long-term business success.?

OIA presented the awards during its annual Thought Leader Dinner, which focused on how the outdoor industry can help shape the future of America?s public lands.

Text-based gaming making a smartphone comeback ? Nokia ...

Text-based gaming making a smartphone comeback

Text-based video games were all the rage during the 70s, 80s, and early 90s, partly due to low processing power on people?s PCs. Despite processing power increasing dramatically, there are still people out there creating these games, as there?s something quite charming about them. One such game, Wizard?s Choice, is available on your Nokia Lumia.

There are probably a lot of you out there who have never played a text-based game before, and instead rely on visual graphics to stimulate your senses. Text-based games ignite the brain in different ways and force your mind to conjure up your own images using nothing but good old-fashioned imagination ? much like reading a book. This provides a different gaming-experience to each and every person who plays it.

?An arrow whistles past your head. You look back and see at least four sets of glowing eyes.?

?What do you do??

Wizard?s Choice?is full to the brim of such questions, and it?s up to you to answer correctly or the nasties in the game will soon ?end? you and you?ll need to start all over again.

As the title suggests, you are a Wizard and you?re on a quest to rid the world of evil and collect treasure along the way. I?m sure there?s a fair maiden that needs rescuing thrown in for good measure, too.

Forest Decisions

The story begins in a forest as night begins to fall. Woods can be a frightening place, especially with orcs tailing your every move ? it?s the stench and glowing eyes that give them away. How best to deal with such malodorous beasts? Stay and fight, run and hide, or leg it? All are viable options.

However, whatever decision you make will have consequences for the rest of the game. If you make the wrong decision, you may feel the sharp, burning head of an enemy arrow, losing some of your precious health points.

If you opt to use your magic to escape a situation, your manna points will be reduced, and a wizard with no manna is almost as useless as a warrior without a sword.

Use your skills wisely, and sensibly.

Throughout your journey are moments to earn morale for your fighting party and even the opportunity to earn some money. Orc ears make a tidy profit on the black-market, apparently.

The storyline is descriptive and often funny. Both of which is perfect material for allowing your own mind to create the scene. Having said that, there is the odd scattering of illustrations to help you visualise this mysterious world.

Illustration Game-over

As for the gameplay, it doesn?t get much easier. Once you?ve read the story on each page, your only task is to select what to do next and press the relevant button.

Don?t worry about saving your progress, the game autosaves at every step on the way. When you load up the game in future, you?ll be taken to the exact same point you left off.

Wizard?s Choice?is gaming from the past, delivered beautifully to open-minded gamers and into the modern world of smartphones.

Available on Nokia Lumia 920, Lumia 820, Lumia 800 and Lumia 900. Download it for free, today. Paid options allow you to avoid the adverts.

Do you remember text-based gaming the first time around? Or are you trying this for the first time? Let us know, below.

Analysis: Once reliable technology sector drags down earnings

NEW YORK (Reuters) - This earnings season, the U.S. technology industry is in an unusual position - dragging corporate America down, rather than lifting it up.

Wall Street expects the tech sector's fourth-quarter earnings to be down 1.1 percent from a year ago, the first drop since the third quarter of 2009, even though overall S&P 500 profits are still forecast to show growth, according to Thomson Reuters data.

Chip companies are expected to be among the worst performers because of softer-than-expected personal computer sales. Weak overseas demand and worries about the U.S. fiscal crisis have also likely caused corporations to put off IT spending.

"The lack of economic growth we've seen in Europe, the deceleration of emerging markets - that has put a significant amount of pressure, particularly on technology," said Omar Aguilar, chief investment officer for equities at Charles Schwab Corp, in San Francisco.

Tech stocks have struggled recently and further weakness could dent the bullish 2013 forecasts many strategists have for the U.S. stock market. But some investors and analysts say weak fourth-quarter numbers have already been baked into many tech stock prices and valuations are attractive.

Analysts at Bank of America Merrill Lynch wrote in a note this week that tech stocks are undervalued by about 32 percent, more than any other sector, based on current forward price-to-earnings ratios. Every tech industry except IT services is trading well below historical levels, the note said.

Within tech, "you're finding a lot of cash-rich companies trading at reasonably cheap multiples. So to value investors like us ... it starts to seem intriguing," said Eric Kuby, chief investment officer at North Star Investment Management Corp in Chicago, whose firm owns Microsoft Corp and Intel Corp.

It is unusual for tech, the largest of the Standard & Poor's 500 index's 10 industry sectors and accounting for nearly 23 percent of earnings, to underperform. Tech has been in the top half of S&P sectors for the last four earnings periods and it has posted stronger profit growth than the overall market 83 percent of the time in the last 10 years, according to Thomson Reuters.

Apple Inc usually provides one of the biggest boosts to U.S. corporate earnings, but this time its December quarter profit is forecast to fall 3.8 percent year on year, compared with the S&P 500's overall 1.8 percent profit growth, according to Thomson Reuters data.

Apple has only missed analyst earnings expectations four times in the last 10 years, two of those in the most recent reporting periods, Thomson Reuters data showed. Its shares are down again this week after reports the company is ordering fewer components because of lower-than-expected demand for its iPhone5.

But even Apple stock, which fell below $500 a share on Monday for the first time since February, is looking more attractive to value investors, Kuby said.

INTEL FIRST

The bulk of technology companies do not start to report results until next week, but Intel is due out on Thursday.

Among tech's sub-industries, 13 semiconductor companies are expected to report an aggregate 28.4 percent fall in quarterly profit and four semiconductor equipment makers are expected to see a 50.7 percent drop, Thomson Reuters data showed.

Texas Instruments Inc was among top chip companies that have warned on the fourth quarter, along with Applied Materials Inc. Texas Instruments, which last cut its profit target in December, cited restructuring charges. The stock closed on Tuesday at $32.28, off its $34.24 high in March.

Others warnings have come from Cisco Systems Inc, Hewlett Packard Co and Qualcomm Inc.

The S&P 500 tech sector rose 13.2 percent in 2012, about the same as the S&P 500's 13.4 percent gain, but tech stocks by at least one measure have been underperforming since September. The SPDR XLK technology fund ETF ended last quarter with a loss of 6.1 percent, while the S&P 500 was down just 1 percent.

"The S&P 500 peaked in mid-September, had a pullback and it's already pretty close to that September high. Contrasting that, the XLK hasn't even come close to getting back to where it was in September," said Chris Burba, co-founder and chief technical strategist at miAnalysis Inc in New York.

BB 10 Twitter and Google Talk app integration leaks ahead of launch

Image

Care for a sneak peek at BB 10's third party app integration? Well, if the screens above are to be believed (and we have reason to assume they're quite legit), standalone applications like Twitter and Google Talk could be ready to download on BlackBerry World at launch. From what we can glimpse, it appears the apps will be folded into BB Hub, the OS' new unified inbox, lending further credence to RIM's claims of a seamless "flow," as it doesn't seem likely social applications will be sandboxed. Design-wise, both apps offer a direct parallel to their current offerings on other rival platforms, albeit made to fit the straight and soft BB 10 aesthetic. We'll know much more in the weeks ahead as RIM prepares to reveal the full monty. For now, buckle in for a load of expected leaks.

ERG Property Advisors | Finance Division | Jason Au

ERG launches in-house finance division

Investment sales firm recently merged with mortgage brokerage JG Capital

January 14, 2013 05:30PM
By Guelda Voien

Jason Au, of ERG Property Advisors? new finance division

ERG Property Advisors, the Manhattan-based investment sales brokerage launched in 2009, has formed a finance division, company executives told The Real Deal. The new division will broker both traditional and non-traditional loans between $500,000 and $50 million for ERG buyers, new division head Jason Au said. Au comes from mortgage broker JG Capital, which merged with ERG last August. The new five-person team should expand to nine brokers in the next six months, Au said.

As far as the timing of the new division launch late last year, Au pointed to low interest rates and lots of available private money.

?It just made sense, [to launch the division] because ERG has started to build a pretty nice reputation,? Au said. ?We want to go out there and make a splash and make smart deals.?

Among ERG?s current listings is a development site at 2211 Third Avenue in Harlem, with 125,000 buildable square feet, a representative for ERG said. The asking price for the parcel is $11.5 million.

And ERG is building on JG Capital?s history of taking advantage of market conditions. JG Capital was formed in 1993, amid tightened lending in a real estate market where very little was trading. The firm began marketing traditional bank loans at that time, but in 2009, in another eriod of economic turmoil, JG Capital formed its first private fund, HVB Two LLC, which originates loans in the $500,000 to $2 million range, Au said.

Au now runs that fund, while ERG Chairman James Guarino runs the company?s new larger fund, called NYRE Loan Fund I LLC. That fund originates loans in the $2 million to $50 million range, he said.

Au could not disclose the interest rates for the private bridge loans, but said that those loans were about 35 percent of ERG?s finance division?s business.

?Banks are aggressively lending ? the private money is available,? Au said. ?It?s a good time to make a mark.?

Lance Armstrong visits Livestrong Foundation to apologize to staff

AUSTIN, Texas, Jan 14 (Reuters) - Lance Armstrong on Monday visited the Austin, Texas, office of the cancer foundation he started to apologize to the staff of about 100 people, a spokeswoman for the Livestrong Foundation said.

"He had a private conversation with the staff, who have done the important work of the foundation for many years," said foundation spokeswoman Katherine McLane.

The apology came on the day that Armstrong was scheduled to tape an interview with Oprah Winfrey to air on Thursday -- his first interview since being stripped of his seven Tour de France titles.

The disgraced cyclist plans to admit in the interview to doping throughout his career, USA Today reported on Saturday.

France won't buy troubled Petroplus refinery: Hollande

VAL-DE-REUIL, France (Reuters) - France will not take over insolvent Swiss refiner Petroplus' oil refinery in Normandy, but could help the plant financially once a suitable buyer is found, President Francois Hollande said on Saturday.

About 500 jobs at the 161,000 barrels-a-day Petit-Couronne refinery are at risk, the latest industrial headache for the Socialist leader who has vowed to stem rising unemployment by the end of the year.

"It's difficult to find a serious buyer. We must do everything to find one," Hollande told reporters after meeting union leaders in Val-De-Reuil, a town about 110 kilometers (70 miles) north-west of Paris.

"The state will do its duty, but it cannot take the plant over, and the workers know that," he said.

He added the state could at some point provide financing.

Petroplus poses a major test for Hollande's government after it faced criticism over the tactics it used in a two-month battle over the future of ArcelorMittal's Florange steel plant, which unnerved investors in the euro zone's second largest economy and confused France's unions.

His administration is struggling to stop a haemorrhage of industrial jobs which has helped push unemployment to 15-year highs, while curbing public spending and raising taxes to help slash debt in a stagnant economy.

A French court set a deadline of February 5 for interested parties to submit bids for the Petit-Couronne refinery.

Shell , which had a six-month oil processing deal with the troubled plant running to mid-December, has not extended its contract, making the refinery less attractive for buyers due to expensive restart costs.

So far only NetOil, a company led by Middle Eastern businessman Roger Tamraz, has submitted an offer while 7 others have filed letters of intent to buy France's oldest refinery.

Net Oil's offer includes an oil supply deal with BP and an agreement with Hyundai to upgrade the plant.

Union spokesman Yvon Scornet told reporters after the meeting that Hollande had promised to do everything possible to push the project forward, but had given no guarantees.

TAKING CHARGE

Hollande is trying to win back voters who are increasingly unhappy over the government's handling of the economy and disillusioned by communication gaffes.

A survey by BVA for I>Tele on Friday showed two-thirds of respondents were not convinced by Hollande's New Year's address aimed at reassuring the country over his policies.

Approval ratings for Hollande and Prime Minister Jean-Marc Ayrault hit new lows in December.

Hollande, seen as letting his ministers lead the fight, has been compared unfavourably with his pugnacious, micro-managing predecessor Nicolas Sarkozy.

However, the president, who appointed a new communications advisor on Thursday, appears to have decided to put himself directly in the firing line promising to carry out at least one visit a week across France to show his commitment to battling the economic crisis.

"Today, I have to be more present on the ground," he said. "I have to set the example as I am the first to blame. I am not delegating to anybody else the responsibility of explaining to the French the policies that I am pushing through."

Why November's US unemployment rate was revised up

Unlike most economic data from the U.S. government, the monthly unemployment rate isn't usually revised later. If, for example, the Labor Department says the rate was 7.7 percent in a particular month, that rate normally stays 7.7 percent.

Until January, that is.

Every January, the government updates the formulas it uses to calculate unemployment data. The new formulas can change some of the rates for the previous five years. Typically, though, only a few of the monthly rates are revised.

On Friday, the government revised the unemployment rates for two months in 2012. The rate for November, first reported Dec. 7, was revised up to 7.8 percent from 7.7 percent. And the rate for July was revised down to 8.2 percent from 8.3 percent.

By contrast, monthly job creation numbers are revised twice in the two months after they're first released. They're also revised annually. The result is a frequently substantial gap between an initially reported jobs total and the final revised total.

For example, the government initially said employers added only 96,000 jobs in August. That wouldn't generally be enough to lower the unemployment rate. But the number jumped after two revisions to a robust 192,000.

The unemployment rate for that month still stands at 8.1 percent ? just as the government originally reported.

Atom smasher goes on hiatus for big revamp

GENEVA (AP) ? The world's largest and most powerful atom smasher goes into a 2-year hibernation in March, as engineers carry out a revamp to help it reach maximum energy levels that could lead to more stunning discoveries following the detection of the so-called "God particle."

With the reopening of its $10 billion proton collider in early 2015, the stage will be set for observing more rare phenomena ? and unlocking more mysteries, said James Gillies, chief spokesman for the European particle physics laboratory known as CERN.

The Large Hadron Collider under the Swiss-French border will operate for two more months then shut down through 2014, allowing engineers to lay thousands more superconducting cables aimed at bringing the machine up to "full design energy," Gillies told The Associated Press on Friday.

Physicists at the European Center for Nuclear Research, known by its French acronym CERN, won't exactly be idle as the collider takes a break. There are still reams more data to sift through since the July discovery of a new subatomic particle called the Higgs boson ? dubbed the "God particle ? which promises a new realm of understanding of the universe.

For the next two months, the Large Hadron Collider will be smashing protons with lead ions, then undergo several weeks of testing before it shuts down. The collider launched in September 2008, but had to be switched off just nine days later when a badly soldered electrical splice overheated, causing extensive damage to the massive magnets and other parts of the collider some 300 feet (100 meters) below the ground.

It cost $40 million to repair and improve the machine. Since its restart in November 2009, the collider has performed almost flawlessly and the power produced has been ramped up to ever-new record levels, creating a treasure trove of new data to sift through.

But because of the 2008 accident, the collider could only run at an energy level far below what it was designed to do. To fix that, Gillies said, engineers over the next two years will install 10,000 redesigned superconducting cables that connect between the magnets. That will vastly improve its capacity to simulate the moments after the Big Bang nearly 14 billion years ago.

"It will bring you more collisions. Which means that the more collisions you have, the more likely you are to see rare events," he said. "The Higgs particle was just one of many on the wish list that we'd like to find, so higher energy increases your discovery potential."

Apple rumored to be testing Touch on Display screen tech for next iPhone

Apple rumored to be testing Touch on Display screen tech for next iPhone

Apple is rumored to be testing a new screen technology for the next iPhone, manufactured by Innolux, called ?Touch on Display?. It's said to be both thin a durable, and could potentially fix problems that have been associated with the current in-cell technology, namely buggy touch responsiveness when swiping at extreme angles. This according to The China Times.

The current in-cell displays are manufactured by a number of companies, including Japan Display and Sharp Display. In-cell display was one of the new features of the iPhone 5, and made it possible for Apple to decrease the thickness of the device.

If Apple is looking to replace it, they?ll want to find a panel that allows them to keep the iPhone as thin as it is now. Not much is known about the next iPhone, which Apple is currently testing, but more information is sure to crop up before it launches sometime this year.
