6.3 earthquake shakes Peru but no injuries or damage reported (Reuters)

LIMA (Reuters) ? A earthquake of 6.3 magnitude rattled the coast of Peru early on Monday, the U.S. Geological Survey said, but there were no immediate reports of damage or injuries.

The quake occurred shortly after midnight local time (1 a.m. ET) and was centered about 9 miles southeast of the city of Ica and about 170 miles south-southeast of Lima.

Witnesses said the quake shook buildings in coastal Lima, Peru's capital. Although there were no reported injuries or damage, local radio said residents near the epicenter were alarmed and ran outside their homes when they felt the quake. Power was out in nearby Pisco, the radio said.

"We felt a terrible earthquake that's really scared us," Ica resident Blanca Cabanilla told the local radio. "It was similar to what happened to us in 2007."

An 8.0 quake in 2007 killed more than 500 people in Ica and wrecked thousands of homes.

Man rescued after being stuck in NM mud for 3 days

ALBUQUERQUE, N.M. (AP) ? A homeless man who was stuck in thick mud near the Rio Grande river in Albuquerque for three days was rescued Saturday after some high school students on a field trip heard him yelling for help, authorities said.

However, the man's newfound freedom wasn't going to last. Police said he was wanted on a felony warrant, and they planned to arrest him after he was treated at a local hospital.

A group of La Cueva High School students and their biology teacher heard the man yelling Saturday morning from a marshy wetlands area in the Oxbow Open Space Preserve, the Albuquerque Fire Department and police officials said.

The students were in the area ? about two miles north of Interstate 40 in Albuquerque ? doing a school project. They called authorities and told them that the man said he'd been stuck in the river for three days and could not move, according to a police report.

Fire crews and preserve officers responded and found a "male subject stuck on a reed island about a hundred yards from the west bank of the river," the report said.

Crews deployed an air boat and used a pulley system to lift the man from the mud and water, and up a hill.

Police later identified the man as Clayton Senn, a transient who'd been living near the river.

Authorities said they discovered a warrant for Senn's arrest on suspicion of aggravated assault with a deadly weapon, a felony. Senn was taken to an Albuquerque hospital for treatment and was to be booked on the warrant upon his release, police said.

Details on Senn's condition were not immediately available.

BP emails reveal company veiling spill rate (AP)

NEW ORLEANS ? On the day the Deepwater Horizon sank in the Gulf of Mexico, BP officials warned in an internal email conversation that if the well was not protected by the blow-out preventer at the drill site, crude oil could burst into the Gulf of Mexico at a rate of 3.4 million gallons a day, an amount a million gallons higher than what the U.S. government ultimately estimated spilled daily from the site.

The memo, which BP agreed to release Friday as part of federal court proceedings, suggests BP managers recognized the potential of the disaster in its early hours, and the company officials sought to make sure that the model-developed information wasn't shared with those outside the company. The emails also suggest BP was having heated discussions with Coast Guard officials over the potential of the oil spill.

The memo was released as part of the court proceedings to determine the division of responsibility for the nation's worst offshore oil disaster, which began when the BP-leased Deepwater Horizon exploded April 20, 2010, killing 11 men about 50 miles southeast of the Louisiana coast. The first phase of the trial is set to start Feb. 27.

BP officials declined to comment on the emails late Friday.

The official amount of oil that flowed from the well was pegged at 206 million gallons from at least April 22 until the well was capped on July 15, a period of 85 days. That's a daily flow rate of about 2.4 million gallons ? two-thirds of the way to BP's projection of what could leak from the well if it was an "open hole." BP has disputed the government's estimates.

Having an accurate flow rate estimate is needed to determine how much in civil and criminal penalties BP and the other companies drilling the well face under the Clean Water Act.

In the memo, one BP official urges not to share the flow-rate projections and refers to the "difficult discussions" BP was having at the time with the Coast Guard.

Gary Imm, a BP manager, told Rob Marshall, BP's subsea manager in the Gulf, to tell the modeler doing the estimates "not to communicate to anyone on this."

"A number of people have been looking at this we already have had difficult discussions with the USCG on the numbers," Imm said in the email string, referring to the Coast Guard and flow estimates.

On April 23, the Coast Guard, relying on BP's remotely operated vehicles, reported that no oil was leaking from the well a mile under the sea. A day later, Coast Guard Rear Adm. Mary Landry announced that oil was leaking an estimated rate of 42,000 gallons a day. The Coast Guard and BP did not divulge how they determined that figure.

In the second week after the spill, the official flow rate was increased to 210,000 gallons a day. The government continued to use that number until May 27.

On May 24, BP informed Congress that they had used an "undisclosed method to generate much higher figures" than official estimates, according to a report from a presidential commission investigating the spill. BP estimated that the flow rates were between 210,000 gallons and 1.6 million gallons a day, the January 2011 report said.

As the spill grew into weeks and months, and soiled fishing grounds, beaches and coastal marshes, independent scientists began to question official flow rates. Eventually, the federal government convened teams of government and independent scientists to determine how much oil leaked out of the well and came up with an official estimate of about 2.4 million gallons of oil a day on average.

Actress' claim to be gay by choice riles activists

SAN FRANCISCO (AP) ? Cynthia Nixon learned the hard way this week that when it comes to gay civil rights, the personal is always political. Very political.

The actress best known for portraying fiery lawyer Miranda Hobbes on "Sex and the City" is up to her perfectly arched eyebrows in controversy since The New York Times Magazine published a profile in which she was quoted as saying that for her, being gay was a conscious choice. Nixon is engaged to a woman with whom she has been in a relationship for eight years. Before that, she spent 15 years and had two children with a man.

"I understand that for many people it's not, but for me it's a choice, and you don't get to define my gayness for me," Nixon said while recounting some of the flak gay rights activists previously had given her for treading in similar territory. "A certain section of our community is very concerned that it not be seen as a choice, because if it's a choice, then we could opt out. I say it doesn't matter if we flew here or we swam here, it matters that we are here and we are one group and let us stop trying to make a litmus test for who is considered gay and who is not."

To say that a certain segment of the gay community "is very concerned that it not be seen as a choice" is an understatement. Gay rights activists have worked hard to combat the idea that people decide to be physically attracted to same-sex partners any more than they choose to be attracted to opposite-sex ones because the question, so far unanswered by science, is often used by religious conservatives, including GOP presidential candidate Rick Santorum and former candidate Michelle Bachman, to argue that homosexuality is immoral behavior, not an inherent trait.

Among the activists most horrified by Nixon's comments was Truth Wins Out founder Wayne Besen, whose organization monitors and tries to debunk programs that claim to cure people of same-sex attractions with therapy. Besen said he found the actress' analysis irresponsible and flippant, despite her ample caveats.

"Cynthia did not put adequate thought into the ramifications of her words, and it is going to be used when some kid comes out and their parents force them into some ex-gay camp while she's off drinking cocktails at fancy parties," Besen said. "When people say it's a choice, they are green-lighting an enormous amount of abuse because if it's a choice, people will try to influence and guide young people to what they perceive as the right choice."

Nixon's publicist did not respond to an e-mail asking if the actress wished to comment on the criticism.

While the broader gay rights movement recognizes that human sexuality exists on a spectrum, and has found common cause with transgender and bisexual people, Nixon may have unwittingly given aid and comfort to those who want to deny same-sex couples the right to marry, adopt children and secure equal spousal benefits, said Jennifer Pizer, legal director of the Williams Institute on Sexual Orientation and the Law, a pro-gay think tank based at the University of California, Los Angeles.

One of the factors courts consider in determining if a law is unconstitutional is whether members of the minority group it targets share an unchangeable or "immutable" trait, Pizer noted. Although the definition of how fixed a characteristic has to be to qualify as immutable still is evolving ? religious affiliation, for example, is recognized as grounds for equal protection ? the U.S. Supreme Court still has not included sexual orientation among the traits "so integral to personhood it's not something the government should require people to change," she said.

"If gay people in this country had more confidence that their individual freedom was going to be respected, then the temperature would lower a bit on the immutability question because the idea of it being a choice wouldn't seem to stack the deck against their rights," Pizer said.

Nixon stirred the identity politics pot further when she explained in a follow-up interview with The Daily Beast this week that she purposefully rejected identifying herself as bisexual even though her history suggested it was an accurate term.

"I don't pull out the "bisexual" word because nobody likes the bisexuals. Everybody likes to dump on the bisexuals," she said. "But I do completely feel that when I was in relationships with men, I was in love and in lust with those men. And then I met (her fianc?) Christine and I fell in love and lust with her. I am completely the same person and I was not walking around in some kind of fog. I just responded to the people in front of me the way I truly felt."

Although science has not identified either a purely biological or sociological basis for sexual orientation, University of California, Davis psychologist Gregory Herek, an expert on anti-gay prejudice, said Nixon's experience is consistent with research showing that women have an easier time moving between opposite and same-sex partners.

A survey Herek conducted of gay men, lesbians and bisexuals of both genders bore this out. Sixteen percent of the lesbians surveyed reported they felt they had had a fair amount of choice in their sexual orientations, while only five percent of the gay men did. Among bisexuals, the figures were 40 percent for men and 45 percent for women.

What remains to be teased out, Herek said, is how a representative national sample of heterosexuals would answer the same question, and what people mean when their sexual orientation was a choice or not. Are they talking about their sexual desires? Acting on those desires? Or simply the identity they choose to show to the world?

"The nature vs. nurture debate really is pass?," he said. "The debate is not really an either/or debate in the vast majority of cases, but how much of each. We don't know how big a role biology plays and how big a role culture plays. A possibility not often discussed is it's not the same for everybody."

Oops! Slide deployment delays flight

A Virgin America flight was delayed several hours Wednesday night after the accidental deployment of an emergency slide.

"A slide was inadvertently deployed by a maintenance worker during a routine check on a Virgin America Airbus A320 aircraft at the gate at JFK," airline spokesperson Abby Lunardini told msnbc.com via e-mail. No one was on board at the time.

Kate Gardiner, a New York-based journalist booked on the flight, said the snafu resulted in a lengthy delay. "Between rolling it up, finding a new air canister and filling out all of the paperwork ... four hours at JFK," she said.

Virgin America Flight 29 was scheduled to depart JFK for San Francisco at 6:55 p.m. According to Virgin America?s website, the flight left JFK at 10:53 p.m. and arrived in San Francisco at 2:29 a.m.

The 110 affected passengers were issued a $50 credit and a $10 food voucher, Lunardini said.

The pilot, Gardiner added, kept passengers apprised of the situation.

The American Museum of Natural History hosts Beyond Planet Earth Tweetup with Scientific American

I knew it was going to be a wonderful night when I magically found street parking on Central Park West directly across from the American Museum of Natural History. Camera in hand I entered the planetarium where I enjoyed a presentation of vintage films and movies depicting space travel and life on other planets.

I was soon flying towards the ?dark side of the moon? and out into the Milky Way during a 3D presentation of the planets that was out of this world. I then eagerly entered the reception at The Hall of Reptiles and Amphibians where finally the opportunity to shoot presented itself and I took full advantage of capturing the guests, listening to speakers and meeting the editors and bloggers at Scientific American magazine in this magnificent setting.

The Beyond Planet Earth exhibit itself was also an excellent and fun place to shoot and I highly recommend checking out the exhibit yourself in person as there are many interactive apps and ways to explore! I have never had an opportunity like this before and I found the museum, discussions and science exhilarating! Perhaps, if there?s a next time, I can roller skate around the deserted museum taking photos and really bring ?a night at the museum? to life!
